    3. Legal basis

    The provisions forming the legal basis for our data processing according to Art. 13 GDPR are as follows:

    • Art. 6(1) Cl. 1 a) GDPR for the processing of personal details with the consent of the data subject.
    • Art. 6(1) Cl. 1 b) GDPR for the processing of personal data required for the performance of a contract with the data subject and to take steps prior to entering into a contract.
    • Art. 6(1) Cl. 1 c) GDPR for the processing of personal data required to satisfy a legal obligation to which we are subject in accordance with any applicable EU legislation or with any legislation applicable in a country where the GDPR is applicable wholly or in part.
    • Art. 6(1) Cl. 1 f) GDPR for the processing of personal data required to protect the legitimate interests pursued by ourselves or by third parties, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject. Legitimate interests include, in particular, our business and commercial interests associated with providing our website, information security, the assertion of our own legal claims and compliance with other legislative provisions.

    To this end, in the context of delivering our services, we employ service providers committed to confidentiality and to data protection. Data is only passed on to public bodies if higher-ranking legal provisions apply.

    6. Purpose of processing

    General: Presentation of the company, provision of services and/or sale of products and communication via the Internet. The purpose of the data processing on this website is the information about products and services of our company with the possibility of the users to contact the contact persons in the house in a targeted manner.

    6.1 General information

    Insofar as you have provided us with personal data, we use it to answer your inquiries, to advise you and process contracts concluded with you, and for technical administration. Your personal data will only be passed on to third parties or otherwise transferred if this is necessary for the purpose of contract processing or for billing purposes or if you have given your prior consent.     The legal basis for the collection, processing and forwarding of the data in the context of contract processing. is Art. 6 para. 1 (b) GDPR.

    This data is deleted after expiry of the applicable statutory retention obligations. If we are not subject to any statutory retention obligations, the data will be deleted when the purpose ceases to apply. 
    You have the right to information and the right to object to your data stored by us at any time. You can find further information under "Data subject rights" and "Right of revocation".

    6.2 Server data collection

    Purpose of processing
    When you visit our site, various server statistics are automatically stored, which your browser transmits to our provider's server: Among other things, the IP address of your device, date and time of access, name and URL of accessed files, website from which access is made or from which you were directed to our site (referrer URL), browser used and, if applicable, the operating system of your device and the name of your provider are logged.
    The mentioned data is processed by us for the purpose of smooth connection establishment and system security. A combination of this data with other data sources is not made. The IP address is anonymized. The accruing connection data is automatically deleted; usually after seven days at the latest. In the event of misuse of the website, log data whose further storage is required for evidentiary purposes will be retained until the incident has been clarified.

    The legal basis is Art. 6 para. 1 (f) GDPR and § 25 para. 2 TTDSG (here, however, only data such as browser or header information that is transmitted inevitably or due to (browser) settings of the terminal device when calling up our website). This is not to be considered as "accessing information that is already stored in the terminal device". Our legitimate interest according to Art. 6 (1) (f) GDPR arises from the fact that we want to ensure secure operation of the website and detect any attacks.

    6.3 Contact form and request by e-mail

    Purpose of processing
    When you use our contact form, we will collect and store the name and e-mail address for the purpose of answering your inquiry. The specification of the telephone number for a callback is optional. If you send us a contact request by e-mail, we will collect and store the e-mail address and the data contained in the e-mail.

    The legal basis is Art. 6(1) Cl. 1 a) GDPR, as you - by using the form and sending an e-mail message - consent to the above-mentioned processing of your data. The legal basis furthermore arises from Art. 6(1) Cl. 1 b), as the storage of the data is necessary for the fulfillment of a pre-contractual or a contractual relationship that may be established at a later point in time.

    The data will be deleted when the purpose of storage has ceased to apply, i.e. after answering your e-mail/contact form inquiry or when the matter connected with the inquiry has been finally clarified.

    You have the right to revoke your consent at any time without affecting the legality of the processing based on the consent.

    6.4 Newsletter and e-mail marketing

    Purpose of processing
    You can unsubscribe from our newsletter at any time by revoking your consent. You will find a link to unsubscribe from the newsletter at the bottom of each newsletter. We may store unsubscribed email addresses for up to three years based on our legitimate interests before deleting them in order to prove that consent was previously given. The processing of this data is limited to the purpose of defense against any claims. It is possible to make an individual deletion request at any time, provided that you also confirm having previously given your consent.

    The legal basis is Art. 6 (1) (a) GDPR as – by subscribing to the newsletter and sending an email – you consent to the processing of your data as indicated above. The legal basis also arises from Art. 6 (1) (b) GDPR as the storage of the data is necessary for the fulfillment of a pre-contractual or a contractual relationship that may be established at a later point in time.

    6.5 Hubspot

    Purpose of processing
    We not only use Hubspot to send our newsletter/info mail, but also for our online marketing activities. This is an integrated software solution that we use to cover various aspects of our online marketing.
    These include, among other things:

    • Content management (website and blog)
    • E-mail marketing (newsletter/infomail, as well as automated mailings, e.g. to provide downloads)
    • Social Media Publishing & Reporting
    • Reporting (e.g. traffic sources, accesses, etc. ...)
    • Contact management (e.g. user segmentation & CRM)
    • Landing pages and contact forms
    • Our signup service allows visitors to our site to learn more about our business, download content, and provide their contact information and other demographic information.

    This information and the content of our website are stored on the servers of our software partner HubSpot. They can be used by us to contact visitors to our website and to determine which of our company's services are of interest to them. All information we collect is subject to this Privacy Policy. We use all collected information exclusively to optimize our marketing.

    6.6 Google Analytics

    Purpose of processing 
    Google Analytics is a web analytics service provided by Google Ireland Ltd ("Google"). Google uses the data collected to track and study how this website/app is used, to compile reports on its activities and to share them with other Google services.     6.7 Meta

    Purpose of processing 
    Within our website(s) we use the so-called "Facebook pixel" of the social network Facebook, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or if you are located in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook").

    YouTube is a video sharing platform that allows users to upload, watch and share videos, including movie and music clips and amateur content. Company processing data is Google Ireland Ltd Gordon House, Barrow Street Dublin 4.

    The legal basis is your consent pursuant to Art. 6 para. 1 (a) GDPR. We process data with the help of Youtube for the purpose of optimizing our website and for marketing purposes.     6.9 LinkedIn

    Purpose of processing
    Our website uses functions of the social network LinkedIn. The provider is LinkedIn Corporation, 1000 W Maude, Sunnyvale, CA 94085, USA, represented in Europe by LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland. Every time you access one of our pages that contain LinkedIn functions, a connection is established to LinkedIn servers.     6.10 Cookiebot

    Purpose of processing
    Stores the user's consent status for cookies on the current domain. cookiebot offers services to obtain consent from your website visitors and provide this information to your advertisers and other partners, as well as collects data on user behavior of website visitors in terms of frequency and duration.

    The legal basis is Art. 6 (1) (f) GDPR and Section 25 (1) German Telecommunications Telemedia Data Protection Act (TTDSG). Our legitimate interest or necessity is described below per cookie/function.

    6.11 Job applications

    Purpose of processing
    When you apply for an open position with us, we will collect your personal data such as first name, last name, address, telephone number, e-mail address, documentation (cover letters, CV, job references, photo) and store them for the duration of the selection process.
    Your personal data will only be used by authorized persons from the HR department and/or management within the scope of the selection process. Your personal data will not be passed on to third parties.
    If the specific position that you are applying for should be granted to someone else and you could still be considered for later employment or employment in a partner or subsidiary company due to your profile, then we will request your express permission before further storage or sharing of your application unless you have otherwise already provided your express permission in your application for this type of storage and/or sharing.
    If you apply for a position with us on your own initiative using our general contract e-mail address, then the content of your application e-mail can be read by non-authorized personnel. For this situation, the guideline is in place that the application documentation should remain unopened and immediately be forwarded to the HR department and the incoming e-mail deleted. If you would like to exclude this, we ask that you please get in contact with us via telephone before sending your unsolicited application so that we can provide you with the contact information of the appropriate contact person.

This comes from either inquiries from interested customers and contact requests, or order placement and order processing (see section “Data collection and processing”).

    Data collection and data processing is required for the performance of a contract and based on Art. 6 Para. 1 (b) GDPR. The use for direct marketing is based on Art. 6 Para. 1 (f) GDPR. It is in our legitimate interest to make you aware of special offers by means of direct marketing.     Dr. Paul Lohmann GmbH & Co. KG operates a corporate presence on Facebook, Xing and LinkedIn.
    As there are diverse – and justifiably so – discussions regarding data protection, we would like to inform you accordingly here.

    We operate this presence based on our legitimate interest to communicate with the users active there and to provide information on the networks/platforms.

    Legitimate interests (Art. 6 (1) (f) GDPR) – Processing is necessary for the purposes of the legitimate interests of the data controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data.

    Since this always involves data processing by the providers of the networks (usually for market research and advertising purposes) and some of this processing takes place outside the European Union, our presence is only directed at the respective users who are active there and who have consciously agreed to the terms of use of the respective providers.

    Here, the US providers undertake to offer comparable guarantees of a secure level of data protection as the EU's data protection standards.

    In the consideration and implementation, we take into account in particular:

    • No exclusive information on the social networks and platforms, but purely information about posts and events on our own website.
    • No advertising and announcement of our presence outside the respective networks/platforms – i.e. no explicit recruitment of users who have not agreed to the terms of use.
